These terms apply when you use sleepygirl.com.au or buy from Sleepy Girl. By using our website or placing an order, you agree to them. Our Shipping Policy, Refund Policy and Privacy Policy also form part of these terms.
1. About us
Sleepy Girl ("we", "us", "our") is an Australian business selling mulberry silk sleep essentials online. You can reach us at hello@sleepygirl.com.au or by post at 2D Figtree Drive, Sydney Olympic Park NSW 2127.
2. Our products
a. We take care to show our products accurately. Silk is a natural fibre, so shades can vary slightly between batches, and colours may look different on different screens.
b. If we find an error in the price or description of something you've ordered, we'll contact you. You can then go ahead at the correct price or cancel for a full refund.
3. Orders
a. Your order is accepted when we confirm it by email. We may decline or cancel an order, for example because of a pricing error, limited stock or suspected fraud. If we do, we'll refund you in full.
b. Please make sure your contact and delivery details are correct. We can't be responsible for delays or losses caused by incorrect details entered at checkout.
c. Some items are made to order or sold on pre-order. The expected dispatch time is shown on the product page and is an estimate. We'll let you know if it changes.
d. If you'd like to cancel, email us as soon as possible. We can cancel orders that haven't been dispatched, or, for custom-size orders, that haven't gone into production.
4. Custom-size orders
a. Custom-size pieces are cut and sewn individually to the measurements you give us. Please double-check your measurements, as we make each piece exactly as requested.
b. Custom-size orders are priced individually, close to the cost of materials and handwork. For this reason, they are excluded from all discount codes, promotions and sale events, including welcome codes, unless we agree otherwise in writing.
5. Prices and payment
a. All prices are in Australian dollars (AUD). Shipping costs are shown at checkout before you pay.
b. Payments are processed securely by third-party payment providers. We don't store your full card details.
c. We may change our prices at any time, but changes won't affect orders already placed.
6. Discount codes and promotions
a. Discount codes must be entered at checkout. They can't be applied to orders already placed and can't be exchanged for cash.
b. Only one discount code can be used per order unless stated otherwise.
c. Each promotion may have its own conditions, such as a minimum spend, an end date or excluded products. Custom-size orders are always excluded.
d. We may change or end a promotion at any time. This won't affect orders already placed.
7. Shipping and delivery
a. We currently ship within Australia and to New Zealand. Rates and delivery times are set out in our Shipping Policy.
b. Delivery times are estimates and can be affected by the carrier. If your parcel is lost or arrives damaged, please contact us and we'll help sort it out.
8. Returns, refunds and faulty items
a. Change-of-mind returns are accepted in line with our Refund Policy. Items must be unused, in their original condition and packaging, and returned within the stated timeframe.
b. For hygiene reasons, pillowcases and pillows can't be returned once used unless they are faulty.
c. Please make sure your pillow insert is the right size for your pillowcase. Damage caused by an oversized or overstuffed insert, particularly around the zip, or by not following the care instructions, is not a fault.
d. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
9. Using our website
a. You agree to use our website lawfully and not to interfere with it, copy it, or scrape its content.
b. If you create an account, please keep your login details secure. You're responsible for activity on your account.
10. Intellectual property
All content on our website, including text, photos, logos and designs, belongs to Sleepy Girl or our licensors. Please don't copy or use it without our written permission.
11. Our liability
Nothing in these terms limits your rights under the Australian Consumer Law. To the extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of our website or products.
12. Privacy
We handle your personal information as described in our Privacy Policy.
13. Governing law
These terms are governed by the laws of New South Wales, Australia.
14. Changes to these terms
We may update these terms from time to time. The version on our website when you place an order is the one that applies to that order.
